In Consideration Thereof:

The agreement made this day _____________, between ______________, herein after known as the "Promoter", and Jason Fellows, aka: Dj Prothose, herein after known as the "Artist", affirms a mutual agreement between both parties. In regards to this agreement,the Artists and the Promoter agree to the following terms of contract:

Performance Fee:

The Promoter agrees to pay the Artist a performance fee of ____________ ($ ) dollars. This fee is to be paid in full in cash before the scheduled performance of the Artist.

The Promoter agrees to pay a retaining deposit in the total amount of ______________, ($ ) dollars. This retaining deposit must be paid no later than seven (7) days after the Promoters signing date of the contract. All deposits will be paid in the form of cash, a United States Postal Money Order, or Cashiers check. All checks and money orders will be made out to the Artist. No personal checks will be accepted. In the event that the retaining deposit has not been paid by the Promoter and/or received and confirmed by the Artist, this agreement is no longer valid and binding.

The Promoter agrees to pay the remaining balance, in full, ____________ ($ ) dollars immediately prior to the scheduled performance.


Travel and Lodging:

The Promoter and Artist are both in agreement that "no / yes" special travel accommodations need to be made for this event. Artist agrees to provide adequate personal transportation to and from the above mentioned event, unless otherwise stated for special travel accomidations to be met.

In the event for special travel arrangements, the Artist prefers to fly by Northwest Airlines out of Hattiesburg/Laurel Regional Airport or from Jackson, MS International Airport. Any and all travel to and from airport, venue, hotel, or anywhere during event dates, the promoter agrees to provide adequate transportation at no cost to the artist. (PLEASE NO UGO'S)

The Promoter agrees to provide one (1) double hotel rooms for One (1) night of accommodations and assures that the accommodations provided will be at a reputable hotel. The Promoter agrees that the rooms will be reserved in the name of the Artist. Hotel must be four star or better in class rating. Artist preffers to stay at The Courtyard by: Marriot when available.


Performance:

The Promoter agrees to provide the Artist a performance time of no less than one (1.0) hour and no more than three (3.0) hours between the hours of 11pm and 3am. (Artist will not play a set that begins at 3am)

The Artist will perform on fully functioning professional grade equipment, (IE Two (2) Technics 1200 MK2 turntables, Two (2) turntable styli, Two (2)Pioneer CDJ 800 or 1000 players w/ adjustable pitch control, a Pioneer DJM 500 or higher series mixer manufactured by Pioneer [other mixers may be used only if prior arrangements have been made with the Artist], and a professional grade P.A. system with Two monitors) to be provided by the Promoter.

The Promoter agrees that the Artist shall have sole control over the performance during the Artist timeslot. The Promoter also agrees that no special performance situations (IE concurrent or alternating DJs during the Artist designated timeslot, other performers, or vocalists) will be conducted without prior approval of the Artist.

Artist Performance Billing and Logos:

The Artist will receive equal billing with any and all headliners (100% of the largest typeface used) on all promotional material, printed or otherwise. The Artist name and company affiliations will be correctly spelled on all promotional material, printed or otherwise.

The Artist will provide the Promoter with the Artist promotional logos to be visibly placed on all promotional materials, printed or otherwise. The logos may be resized, but they must remain legible and in a noticeable area.

Event Cancellation:

The Promoter agrees that in the event of cancellation, notice to the Artist must be received at least fourteen (14) days prior the performance date, that the Promoter has no obligation to make further payments.

The Promoter agrees that in the event of cancellation less than fourteen (14) days before the scheduled performance date (including but not limited to closure of the event venue due to any local, state, and/or Federal Government agency), that the Promoter agrees to maintain liability for the remaining amount of Artists performance fee due hereunder.

The Promoter agrees that in order to be relieved a further payment obligation, notice of cancellation must be received by the Artist via phone or email (with confirmation email required) The date of cancellation request delivery will be recorded as date of cancellation request receipt.

The Promoter agrees that in the event of any Act(s) of God which prevent the Artists from performing on the above stated performance date, such as: Snow Storms, Tornado, Earthquake, Hurricane, Airline crash, or National/International Security conflicts, the Artists will not be held liable, and may be permitted to keep all deposits. In the event that the performance of the Artists is cut short by a noticeable amount by any action of the Promoter, any law enforcement, venue owner or manager, or by technical problems with any P.A. system, electrical system or air-conditioning system, the Promoter agrees to remunerate the Artist in the full amount of the original performance fee in cash.


Artist Requirements:

Upon the Artist arrival to the event space, the Promoter agrees to provide the Artists with the following items:

Six (6) bottles of Corona Light with individual slices of lime for each
Two (2) guest pass & One (1) personal security pass for the artist
Three (3) one liter bottles of water or four (4) 12 oz. or better
One (1) hot meal for artist and one guest / also any other food needs for artist during performance due to health reason's. (PROMOTER'S PLEASE PAY SPECIAL ATTENTION TO THIS)

Promoter and Agent Responsibilities/Guarantees:

The Promoter agrees that no promotional advertisements of the Artist performance will be released previous to the signing of the Artist performance contract and/or receipt of deposit due hereunder.

The Promoter agrees that no recording (audio / video / photography) will be made of the Artist performance without the Artist written consent.

The Promoter agrees, to the best of his ability, to provide a safe and drug-free environment for all attendees and artist, including but not limited to: reasonable air-conditioning or circulation systems (if the Event is to be held indoors), availability of safe drinking water at reasonable or no cost, and adequate security against drug use, sale, and distribution. In the event that the Artist (or the company representing the Artist) perceive that these requests have been violated or disregarded (IE the safety of the venue is questionable, or visible drug use/distribution is evident), the Artist may decline to perform without penalty.

The Promoter agrees to provide adequate security for the Artist and all of the Artist equipment. In any case of theft or vandalism to the Artist equipment, the Promoter agrees to take full liability to refund the Artist at his asking price.

The Promoter agrees that no portion of the retaining deposit, performance fee, extra costs or other provisions provided to the Artist will be paid by any money directly or indirectly related to illegal activities as defined by Federal, State and local statutes.


All of the above said terms of contract are a mutual agreement between both the Promoter and the Artist and is binding with the below signatures of both parties. If needed, the contract may be modified only in writing, and by both the agents and the Promoters initials. The Promoter agrees that all articles and sub-articles of this contract are strictly confidential. The agent and/or Artist reserve the right to cancel performance without reimbersment of deposit if any of articles are not adhered to. If any legal action for either the Promoter or the Artist needs to be taken, the Promoter agrees to fully reimburse the Artist and/or agent for any financial loss, liabilities, and/or damages as a result of Promoters breach of contract. The prevailing party of any legal suit brought to court in regards to the subject matter hereof, will be entitled to reimbursement of court cost, attorneys fees, and/or any additional legal expenses. Finally, the Promoter agrees that any and all legal proceedings will be governed and interpreted under the laws of the state of Mississippi and Mississippi State courts will have soul jurisdiction over all disputes that may rise herunder.


In witness whereof, both parties agree to be bound by the terms of this Agreement.
